1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Foodpapa platform and related services.
By using the platform, you agree to be bound by these Terms and our Privacy Policy.
Foodpapa reserves the right to conduct background checks on any user.

2. Using the Platform

You must create a Foodpapa account to access services.
You are responsible for maintaining the confidentiality of your account information.
You must provide accurate and up-to-date information to facilitate order processing.
Foodpapa may suspend or terminate accounts that violate these Terms.

3. Prohibited Activities

You may not use the platform for unlawful, harmful, or deceptive purposes.
Posting offensive, misleading, or infringing content is strictly prohibited.
Foodpapa reserves the right to remove or modify content that violates these Terms.

4. Intellectual Property

Foodpapa or its licensors own all platform content and trademarks.
You may not use Foodpapa’s trademarks without written permission.
We do not guarantee that platform use will not infringe on third-party rights.

5. Restrictions on Goods

Certain goods are subject to age restrictions and legal limitations.
Delivery of tobacco products and other restricted goods to minors is prohibited.

6. Orders

Orders can be placed via the platform and are subject to vendor acceptance.
An order confirmation will be sent upon processing.
You may cancel an order before it is accepted by the vendor.
Refunds may apply to canceled orders.
Orders may be canceled due to suspected fraud or other issues.

7. Prices and Payments

All prices are in PKR and may include applicable taxes.
Delivery fees may apply based on location and vendor.
Various secure payment methods are available.
We do not store your credit/debit card information.

8. Delivery, Pick-Up, and Vendor Delivery

Delivery zones and availability vary by location.
Delivery times are estimated and not guaranteed.
You are responsible for accepting your order at the designated location.
Report any order issues promptly via the Help Center.
Pick-up orders require following the instructions provided.
Vendor delivery is managed directly by the vendor.

9. Vouchers, Discounts, and Promotions

Vouchers and discounts may come with restrictions and limitations.
Gift cards and vouchers are non-transferable and non-refundable.
Foodpapa may change or withdraw promotions at any time.

10. Representations, Warranties, and Limitations of Liability

The platform is provided “as is” without warranties of any kind.
Foodpapa is not liable for damages resulting from platform use.
Vendors are solely responsible for their services and deliveries.

11. Vendor Liability

Vendors are responsible for product quality and delivery fulfillment.
Foodpapa is not liable for any vendor-related service failures.

12. Personal Data

We collect and process your personal information by our Privacy Policy.

13. Indemnity

You agree to indemnify and hold Foodpapa harmless from any claims or losses arising from your use of the platform.

14. Third-Party Links

The platform may contain external links for convenience.
Foodpapa does not endorse, guarantee, or control third-party content or privacy practices.
Accessing third-party sites is at your own risk.

15. Termination

We reserve the right to terminate or suspend your access for reasons including: violations, fraud, or background check results.
Foodpapa may provide notice, but is not obligated to do so.

16. Amendments

We may revise these Terms at any time.
Updated Terms are effective immediately upon posting.
Continued use of the platform signifies your acceptance of the revised Terms.

17. Severability

If any clause is found invalid, the remaining clauses will remain in full force and effect.

18. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan.
Legal disputes will be subject to the courts located in Karachi, Pakistan.

For inquiries or support, please contact us via the Help Center on the platform.

20. Prevailing Language

These Terms are provided in English, which shall prevail in the event of a conflict with any translation.

21. Rider Tip

Users may optionally tip delivery riders through the platform.
Tips are processed through your selected payment method.
Rider tips are non-refundable after successful delivery.

22. Delivery Service

You can request Foodpapa riders for deliveries (“Orders”).
Delivery fees vary by distance, timing, and demand.
Rider Cancellation: Free cancellation before a rider accepts the order.
User Responsibility: Provide accurate delivery details. Foodpapa is not responsible for failed deliveries due to errors or recipient actions.

23. Warranties and Representations

You confirm authorization to send the item and accept these Terms.
You have permission to share delivery details.
Items are legal and safely packaged.
Prohibited items: Illegal, flammable, radioactive, perishable, narcotics, weapons, etc.
You are liable for any violations or damage caused.

24. Inspections and Legal Requirements

We may inspect packages if concerns arise.
Items may be shown to authorities upon request.
You must cooperate during investigations.

25. Subscription Program

Optional subscription service with separate terms at https://www.foodpapa.com.

26. Priority Delivery Program

Dedicated rider assigned for your order.
Estimated delivery time not guaranteed.
Foodpapa is not liable for issues under this program.
Subject to change or discontinuation without notice.
